Production Privacy Policy (“Privacy Policy”) 

We ask that you review this Privacy Policy carefully.  By applying to participate, you acknowledge and agree to abide by the outlined data collection practices and purposes.  We will provide you with notice if we use your Personal Information in a manner apart from as described in this Privacy Policy. 

Scope

This Policy describes how Marcus Entertainment, LLC, and its affiliates (collectively, “ME”) treat Personal Information collected for the casting of productions and related programming (the “Project”).  This Privacy Policy applies to all visitors to our websites where this Privacy Policy is posted and individual and authorized agents of business entities who apply to be a participant in the Project, including individuals who submit their Personal Information (as defined), members of the public who consent to being recorded, or individuals who otherwise consent to participate in applicable Project (“Project Participants”). 

Information Collected

We collect information in connection with the Project, including information: (i) automatically collected via our websites; (ii) you provide within your application; and (iii) from public sources and other third parties.  Portions of this information may be considered “Personal Information,” as defined under applicable law. Personal Information means information that identifies you or your device or is reasonably associated with you.

Information you provide directly to ME.

The following are types of Personal Information we may request from you: 

– Social media information, including profile information, such as your user name, comments, likes, interests, status, pictures and the address of your website; 

– Contact information, such as name, email address, mailing address, and phone number; 

– Correspondence you send to us; 

– Photos and videos submitted; 

– Date of birth (as permitted by law); 

– Demographic information, such as personal characteristics and work history; 

-Information/content you have permitted a third party to share with ME;  

– Information previously and/or currently available to the public;

– Questions about your business and home, including your gross revenue and other financial information, the products and services you offer, your business operations, your business address, phone number, and website, the size of your home, the number of people in your household, and photos of your home; and  

-Sensitive information from you, with your consent. Where we do not ask you to provide sensitive Personal Information, please refrain from doing so. 

Information Automatically Collected.  

When you access and interact with the casting websites, ME and its service providers may collect certain information. In order to permit your connection to the Platform, our servers may receive and record information about your computer, device, and browser, including potentially your internet protocol (IP) address (which can be used to tell us your general location), browser type, operating system version, and other software or hardware information. If you access the Platform from a mobile or other device, we may collect device identifiers or other information for that device. We also automatically receive information about your interactions with our services, like the pages or other content you view and the dates and times of your visits. Cookies and other tracking technologies are comprised of small bits of data. Our websites and other services may send this data to your browser when you first request a web page and then store the data on your computer or other device so the website can access information when you make subsequent requests for pages from that service. These technologies may also be used to collect and store information about your platform, such as pages you have visited.

Information Obtained from Other Sources.  

Where permitted by law, ME may collect information about you from other sources, including social media, casting agencies, or background check providers. Information collected from third parties may include: 

-Your name, street address, and telephone number(s); 

-Demographic data; and 

-Publicly-observed data. 

NOTE: The disclosure of information to ME by way of third party practices, and their use of your information, is governed by the privacy policies of such third parties.

Data Shared

Disclosure of Production Related Information 

ME may share Personal Information with its affiliates that are connected to the Project. ME also shares your Personal Information with third parties in limited circumstances, for example:

-In Accordance with additional agreements you may executed for the Project. Should you sign a contract with a network in relation to the Project, we will disclose your Personal Information in accordance with the terms of that contract, including when Production content is aired or distributed publicly.

-With your consent, ME may share your contact information with third party marketing partners. 

-ME may disclose sensitive Personal Information contained within Project data to third parties connected to the Project and compile information from third parties in connection with the application process.  ME may reveal such sensitive Personal Information to third parties in the course of the Production application or audition process.

-ME may also engage a third party to provide some of the services associated with auditions, in which case the third party will collect and host the information that you submit to ME but will not use any of this information for purposes other than providing the services in relation to the auditions.  Personal information submitted via the auditions will not be made publicly available by ME and will only be visible to ME, its business partners and ME representatives associated with the auditions and ME platform.

-ME shares your contact information with third party vendors who help ME with specialized services, including production support, customer support, email deployment, business analytics, marketing, suppression list management and data processing. These third parties are allowed to use your contact information to help ME’s services and not for any other purpose.

-You may be asked to provide information about yourself to register for a service offered by a Branded Partner. In doing so, you may be providing your information to both ME and the Branded Partner, or ME may share your information with the Branded Partner. Please note that the Branded Partner’s privacy policy may also apply to its use of your information.  “Branded Partners” are third parties with whom a ME service may jointly offer a service or feature. 

– Where permitted by law, and subject to your right to withdraw consent, ME may share information ME collects about you with other ME affiliated companies so that ME can provide you with information about products and services that might interest you.

-ME may share your information in connection with a substantial corporate transaction, such as the sale of a ME service, asset sale, a merger, consolidation, or bankruptcy.

-ME may disclose information in response to subpoenas, court orders, legal process, and other law enforcement measures, and to comply with other legal obligations.

Disclosure of Platform Related Information

-ME may disclose information to protect and defend the legal rights, interests, and safety of the ME platform, other ME companies, and its employees, contractors, and agents; to protect the safety and security of users of the ME platform and members of the public; and as otherwise disclosed by ME or authorized by law.

-ME may make your Personal Information available to certain 3^rd party service providers, such as contractors, sponsors, or agents, who are involved with the audition process or Project.  These outside service providers are required to protect Personal Information entrusted to them and not use it for any purpose other than the specific service provided to

ME.

How Information Is Used

ME uses your information for the disclosed purposes in ways that are consistent with our interest in production activities, including to:

– Provide, maintain, improve, and enhance our services;

– Understand and analyze how you use our services;

-Share with certain related business entities such as producers, broadcasters, casting directors, and consultants;

-Facilitate auditions;

– Contact you about your application, the casting process, and/or your involvement in the Project as well responding to any of your requests;

-Verify all information you provide to ME for purposes of compliance rules for the Project;

-Fulfill your requests for products, services, and information;

-Provide you with information, special offers and promotional materials on behalf of ME and third parties, in accordance with applicable law, subject to your right to withdraw consent;

– Prevent potentially prohibited or illegal activities;

– Comply with legal investigations and inquiries;

-Process sensitive Personal Information to assess your suitability for the Project or monitor the diversity of our applicants, where permitted by applicable law;

– Protect, enforce, and defend our rights; and

– For any other purposes disclosed to you at the time ME collects your information, pursuant to your consent or as otherwise authorized by law.

Your Choices

– You have choices as to whether cookies and similar technologies are placed on your computer or mobile device. Please review your web browser’s “Help” file to learn how you may modify your cookie settings.

-If you choose to share contact information, you may have the opportunity to update that information on one of our ME services or by contacting us at admin@marcusentertainment.com.  NOTE: ME may need to retain some information about you in order to satisfy ME’s legal and security obligations.  

-ME may send materials or notifications related to the Project or a ME platform. If you want to stop receiving such promotional information, follow the unsubscribe instructions within the applicable communication.

Privacy Protections for Children 

The Platform is intended for a general audience. We do not knowingly collect, maintain, use, or store Personal information about children under the age of sixteen (16), and no part of our services is directed to children. If you learn that a child has provided us with personal information in violation of this Privacy Policy, then you may alert us at admin@marcusentertainment.com.

Third Parties

Our services may contain links to other websites, products, or services that we do not own or operate. We are not responsible for the privacy practices of these third parties. Please be aware that this Privacy Policy does not apply to your activities on these third-party services or any information you disclose to these third parties. We encourage you to read their privacy policies before providing any information to them.

International Visitors

Our services are hosted in the United States and intended for visitors located within the United States. If you choose to use the services from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the U.S. for storage and processing. We may also transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the services. By providing any information, including personal information, on or to the services, you consent to such transfer, storage, and processing.

Changes to This Privacy Policy 

Me reserves the right to change this privacy policy to accommodate changes in technology, industry practices, and regulatory requirements, and for other purposes. We will provide notice to you of material changes, and where required by applicable law we will obtain your consent. Notice may be provided by email to you at the last email address provided, or by posting notice of such changes on our websites, or by other means, consistent with applicable law.
